2. Scope of These Terms
These terms apply to your use of heatingcity.com and, where incorporated into a quotation or booking, to services supplied by Heating City 24/7 Limited. A written quotation, job sheet, booking confirmation or other specific agreement may contain additional terms relating to a particular job.
If a specific written quotation expressly conflicts with a general provision in these website terms, the specific written term will normally apply to that job, subject always to applicable law.
3. Services
Heating City 24/7 provides heating, boiler installation, boiler replacement, repairs, servicing, maintenance, gas-safety, plumbing and related services as described on the website or in individual quotations.
Service availability depends on location, engineer availability, technical suitability, access to the property and the nature of the requested work.
4. Website Information and Guide Prices
We aim to keep website information accurate and useful, but product specifications, availability, manufacturer warranties, installation requirements and prices can change.
Prices described as guide prices, from prices, estimates or online indications are for comparison or initial enquiry purposes. They are not final fixed quotations unless expressly confirmed by Heating City 24/7 in writing.
A final price can depend on matters including the selected appliance, property heat demand, existing pipework, flue route, controls, cylinder or tank arrangement, electrical supply, accessibility and additional work identified during assessment.
5. Surveys, Assessments and Technical Suitability
We may require a site visit, photographs, video call, technical information or other assessment before confirming a final quotation or installation specification.
Recommendations are based on the information reasonably available at the time. If information supplied by the customer is incomplete or inaccurate, the quotation, proposed equipment or scope of work may need to change.
6. When a Contract Is Formed
Submitting a website enquiry or Boiler Quote form does not by itself create a binding installation contract.
A contract is formed when Heating City 24/7 confirms the work and the customer accepts the applicable quotation or booking terms, including any required deposit or payment arrangement.
7. Quotations, Deposits and Payment
The quotation or booking confirmation will state the price, scope of work and any payment requirements applicable to the job.
- Any deposit requested will be credited against the total contract price.
- Payment dates and accepted payment methods will be stated in the quotation or invoice.
- Additional work will not normally be charged without explaining the need for it and agreeing the price or pricing basis, except where immediate action is reasonably required for safety.
- VAT will be charged where applicable at the legally required rate.
8. Consumer Cancellation Rights
Where you are a consumer and enter into a qualifying distance or off-premises contract, you may have a statutory right to cancel within the applicable cancellation period, commonly 14 days.
If you expressly ask us to begin providing a service before the cancellation period has ended and then validly cancel, you may be required to pay a proportionate amount for work already supplied. Where a service has been fully performed following the legally required request and acknowledgement, the right to cancel may end where permitted by law.
Different rules or exceptions can apply to urgent repairs or other circumstances specified by consumer law. Any statutory rights you have will take priority over these general terms.
9. Appointments, Access and Delays
The customer must provide safe and reasonable access to the property, appliance, meters, controls and other relevant areas at the agreed time.
Appointment times are given in good faith. Delays can arise because of emergencies, traffic, previous jobs, parts availability, adverse weather or circumstances outside our reasonable control. We will take reasonable steps to communicate material delays.
An advertised 24/7 or emergency service does not guarantee a particular arrival time unless a response time has been specifically confirmed.
10. Additional or Unforeseen Work
Heating and plumbing work can reveal issues that were not reasonably visible before work started, such as unsafe existing installations, concealed pipework problems, defective valves, unsuitable flues, poor system water quality or electrical defects.
Where additional work is required, we will explain the issue and any effect on price or timescale before proceeding where reasonably practicable.
11. Customer Responsibilities
The customer is responsible for:
- Providing accurate information relevant to the quotation and job.
- Ensuring an authorised adult is available where required.
- Providing safe access to the property and work areas.
- Informing us of known hazards, asbestos concerns, access restrictions or relevant defects.
- Obtaining any permission they are responsible for, such as landlord, freeholder or property-management consent.
- Following reasonable operating and maintenance instructions after installation.
12. Gas Safety and Qualified Engineers
Gas work must be carried out by appropriately qualified Gas Safe Registered engineers with the relevant competence for the work being undertaken.
If an engineer identifies an unsafe gas appliance or installation, safety procedures may require the appliance or supply to be isolated, labelled or otherwise dealt with in accordance with applicable safety requirements.
13. Products, Parts and Manufacturer Warranties
Boiler and component warranties are subject to the relevant manufacturer's terms, registration requirements, servicing requirements and exclusions.
Where a manufacturer warranty applies, it is additional to any statutory rights you may have. Heating City 24/7 does not control a manufacturer's independent warranty decision.
14. Servicing, Repairs and Fault Diagnosis
Fault diagnosis is based on the symptoms and condition present when the engineer attends. Repairing one identified fault does not guarantee that an unrelated or previously hidden fault will not arise later.
Where parts are required, completion can depend on availability, delivery times and manufacturer supply.
15. Quality of Service and Consumer Rights
We will provide services with reasonable care and skill. Where no specific completion time has been agreed, applicable consumer law may require services to be performed within a reasonable time.
Nothing in these terms excludes or restricts rights or remedies that cannot legally be excluded, including rights available to consumers under the Consumer Rights Act 2015.
16. Liability
Nothing in these terms limits or excludes liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or liability that consumer law does not allow us to exclude.
Subject to those protections, Heating City 24/7 is not responsible for losses caused by circumstances outside our reasonable control, or for losses that could not reasonably have been foreseen when the contract was formed.
Customers should take reasonable steps to reduce avoidable loss, including following safety instructions and notifying us promptly of relevant problems.
17. Website Use and Intellectual Property
Website text, original graphics, branding, page designs and other content owned by Heating City 24/7 Limited may not be copied, reproduced or commercially reused without permission, except where permitted by law.
Product names, logos and trademarks belonging to manufacturers or other third parties remain the property of their respective owners.
18. Privacy and Cookies
Personal information is handled in accordance with our Privacy Policy.
Information about cookies, analytics and advertising technologies is available in our Cookie Policy.
19. Complaints
If you are dissatisfied with a quotation, service or installation, please contact us as soon as possible with your name, address, contact details and a description of the issue. We will review the matter and aim to respond appropriately.
Making a complaint does not affect any statutory rights available to you.
20. Governing Law
These terms and any contractual relationship to which they apply are governed by the applicable laws of Scotland and the United Kingdom.
If you are a consumer, nothing in this section is intended to deprive you of any mandatory protections or rights regarding where legal proceedings may be brought.
21. Changes to These Terms
We may update these Terms & Conditions when our services, website, business practices or legal obligations change. The latest website version will display the current revision date.
Changes to website terms do not retrospectively replace specific contractual terms already agreed for completed or ongoing work unless the parties lawfully agree otherwise.
